PUBLIC HEARING (1st Millage Rate) and SPECIAL CALLED COUNCIL MEETING CITY OF BERKELEY LAKE 4040 SOUTH BERKELEY LAKE ROAD BERKELEY LAKE, GEORGIA 30096 Full Minutes for June 7, 2007 12:00 P.M.
Those in attendance for the Council Meeting were as follows: Mayor Pro Tem: Debbie Guthrie Council Members: Walter Anderson, Bernie Cohen, Tom Kitchens and George Sipe City Administrator – Leigh Threadgill Citizens Present- 0
CALL TO ORDER Guthrie opened the meeting at 12:06 pm at 4040 South Berkeley Lake Road.
I. DECLARATION OF MAYOR’S ABSENCE Guthrie stated that it was necessary to have a motion to declare that the Mayor is absent and to give Guthrie the authority to preside in her absence.
Sipe asked why this was necessary because this had not been done in the past. It was explained that this is a requirement of Chapter 3, and Guthrie stated that this had been done before.
Sipe motioned that he didn’t see the Mayor. Anderson seconded the motion.
Guthrie asked for an amendment to the motion to state that the Mayor is unable to attend so the Mayor Pro Tem will preside in her place. Sipe amended his motion accordingly. Anderson seconded the motion. All were in favor. The motion passed.
II. APPROVAL OF OR CHANGES TO THE AGENDA There were no changes to the agenda.
III. PUBLIC HEARING a.) Proposed 2007 Millage Rate Guthrie stated that the city has advertised the public hearing schedule and the millage rate as required by law.
Guthrie asked for any citizen comments and noted that there were no citizens present.
IV. NEW BUSINESS a.) O-56-07, 2007 Millage Rate There was discussion about the process and whether a vote is required at this meeting. The City Administrator, Threadgill, explained that at the May 22, 2007 meeting council voted to set a proposed millage rate, but that at these three meetings it would be necessary for council to vote on this ordinance so that there is a first read, second read and adoption.
Cohen indicated that he wanted to wait to vote for the first read until tonight’s meeting in order to hear citizen comments that may occur at tonight’s meeting.
Anderson stated that he was willing to hold off on the vote for first read until the meeting this evening since it isn’t necessary to have it done until then and the second read and adopt can happen at the final meeting.
Guthrie asked Threadgill to reiterate her findings about the flexibility of increasing the millage rate beyond what was advertised during the course of the three required public hearings. Threadgill stated that an increase to the proposed millage rate would result in having to go back through the process of advertising the new rate and all the public hearings. She further stated that there didn’t seem to be enough time to start this whole process over because of the timeline that we’ve been given by the county to have the information submitted.
Sipe asked what the penalty would be if the millage rate information wasn’t submitted to the county according to their timeline.
Guthrie requested that Threadgill contact the county to determine what the penalty and ramifications would be if the City’s millage rate wasn’t forwarded according to the deadline that had been set. Threadgill agreed to do so.
V. CITIZEN COMMENTS No citizens were present . VI. ADJOURNMENT Cohen motioned to adjourn the meeting. Kitchens seconded the motion. All were in favor. The motion passed.
